In Memoriam: Uthai Ayudvongse ( Dr. Hervey Oei)

Uthai Ayudvongse ( also known as Dr. Hervey Oei) passed away peacefully on November 5 at the age of 94.
Khun Uthai was born on January 22, 1922 in Singapore. He attended the Lyceum Alpinum Zuoz and also obtained his PHD in political economy in Switzerland.

As the Managing Director of the Kian Gwan Public Company Ltd., Khun Uthai was one of the original founding members of AMCHAM in 1956 and was the last living member of the 32 individuals who were on the Chamber’s membership list that year. He was a continuous member of the Chamber for 60 years. AMCHAM maintained the Chamber office in the Kian Gwan building located on the corner of Wireless and Sarasin Road from 1973 until 2005.

We would like to extend our deepest condolences to Khun Uthai’s family, friends, business associates, and all those who knew him. He will be missed.

Plane crash an international tragedy

JAKARTA (JP): A former Singaporean model and her American boyfriend, an Indonesian journalist, a businesswoman returning to her family, an athlete, and a family traveling home after visiting a convalescing relative, were among those on the fateful SilkAir flight.

The stories of those on board is not just an Indonesian tragedy, but an international one because people from 13 nationalities were on board.

Former top Singaporean model Bonny Hicks, who moved to Jakarta in 1992, was on the plane with her longtime boyfriend Richard Dalrymple, better known as Randy, for a long Christmas vacation which would eventually take them to the United States.

After a successful modeling career, Hicks wrote a candid autobiography in 1990, Excuse Me, Are You A Model?

She was due to celebrate her 30th birthday on Jan. 5.

Friends of Hicks said she set up a creative agency here and was living with Dalrymple, an architect, in Simprug, South Jakarta.

Journalist Elly W. Sundari, 40, was on her way to Japan for a three-month study on fashion.

Her father, Atang Hidayat, admitted that he had ill-feelings which he could not shake off before his daughter's departure.

"I felt uneasy for several days before she left because she was wearing a lot of black dresses. She had also told her mother to donate her clothes to charity," Atang said yesterday at Soekarno-Hatta International Airport before boarding a flight to Palembang.

Elly is survived by her 15-year-old son Jimmy Risyandi.

Disbelief was still in the minds of many who knew her.

"We just ignored it when TVRI first broke the news about the crash. I then ask one of my friends what plane mbak Elly took," said fellow journalist Tambrani, who worked with Elly.

Tambrani said everyone burst into tears when they realized Elly was on board.

She had worked for Bisnis Indonesia for 11 years, starting out as a photographer.

Elly's pictures now hang on the wall of the Bisnis Indonesia editorial office above a mound of flowers.

American Suzan Picariello boarded flight MI-185 on her way home to her husband, Brian McNelis, and 2-year-old son.

Picariello was head of consumer services and area general manager for Asia and Southeast Asia at American Express Bank.

Winny Soendaroe, American Express Bank's public affairs and communication manager, said that Picariello had worked for the company for 25 years.

Winny said Picariello had previously been posted in Hong Kong before her current assignment in Singapore.

"Everyone here at Amex knew her. She came to Jakarta almost every week. She'd arrive Friday morning and return in the afternoon after a meeting with me and Bill Pardos, one of the Amex VPs," Winnie told The Jakarta Post yesterday.

"We keep praying that she wasn't on that flight. We haven't heard any news," Winnie said, but adding that she was booked on flight MI-185.

Ali Simon, a relative of passenger Tjiu Tjong Tjoan, tried to remain composed in his grief as he summoned the courage to inform the 42-year-old's wife about the crash.

Ali said here yesterday he was trying to muster the strength to notify Tjiu's wife in Bandung, West Java. "We are still discussing the best possible way to tell her."

Tjiu was an automotive spare parts dealer in Bandung. He was on a business trip to Singapore.

Singaporean Oey Siok Lian, 47, her husband Koh Peng Yam, 48, and 14-year-old daughter Xu Chue Fern were traveling back to Singapore after visiting Oey's brother, Wijanarko, who had just recovered from an illness.

"Oey and her family usually stay at my house in Tebet for about a month," said Nina, Oey's sister-in-law.

Oey shortened her visit to a week because her daughter had to attend a school Christmas celebration.

With no news of survivors as of yesterday afternoon, retired Singaporean Franky was facing up to the fact that he might have lost his brother, Taiwanese Wang Li Ming.

"He was acting very normal before he left," Franky told the Post before departing for Palembang yesterday afternoon.

Franky said he was joking around with his brother on Friday afternoon.

Franky, who often commutes between Jakarta and Singapore, said Wang came to Jakarta to visit him because they had not met for a quite long time.

Another of those on the flight was national shooting athlete Herman Anggoro.

Herman, 36, was known as the nation's shooter in the top reaction pistol category.

In Singapore, Karim Rahman, 51, waited for word on his Malaysian son-in-law Abdul Shukor Abdul Aziz, 35, who was on the flight for a monthly visit to his wife and four children. Abdul Aziz worked in Jakarta as an assistant manager at an electronics firm, AFP reported from Singapore.

"He was supposed to be back last week but had to cancel due to work commitments. It's so unfortunate because he was to celebrate his ninth wedding anniversary on the 31st of December," he added.

"I had to break the news to my daughter," Karim told Singapore's The New Paper, his body shaking with grief.

"Every month, when he comes home, his wife prepares dinner for him. She did the same thing this time. But she waited and waited ..."

Another relative waiting for news in Singapore was Amy Teo, a 47-year-old finance manager whose brother-in-law Tan Chin Heng, 50, was on the flight for a weekend visit from his job with a computer company in Jakarta, AP reported.

"My sister is very distraught and she is imagining all kinds of scenarios. I am trying to comfort her, that he is still alive, but she is saying the area is very swampy, what if he is attacked by crocodiles?" Teo said.

George Joseph was at a party when his wife called to say that his younger brother Joseph, a father of three, was on the flight. "The news is just devastating," George Joseph said. "I rushed immediately to the airport." (10/icn/jun/emb/mds)

BATANGTORU, SUMUTPOS.CO –  PT Agincourt Resources selaku pengelola Tambang Emas Martabe menyambut baik putusan Pengadilan Negeri Padangsidimpuan yang menolak gugatan perdata dari para keturunan Raja Mandongung Pulungan (Alm). Dalam persidangan  yang digelar pada Selasa, 2 Mei 2017 Majelis Hakim yang dipimpin Anggreana Elisabeth Roria Sormin, S.H menjatuhkan putusan untuk menolak seluruh gugatan perdata yang diajukan penggugat.


Dalam amar putusannya, Majelis Hakim menyatakan untuk pokok perkara gugatan perdata atas tanah yang diajukan penggugat, yakni keluarga Pulungan, Majelis Hakim menolak seluruh gugatan penggugat karena semuanya dianggap tidak mendasar dan semua bukti yang diajukan penggugat tidak bisa divalidasi sebagai kepemilikan resmi atas tanah tersebut.

Contohnya Bukti Nomor P-1 Bewijs Van Erkening No.27, Surat berbahasa Belanda yang dikeluarkan Resident Tapanoeli pada 3 September 1931 serta Bukti Nomor P-5 yang merupakan terjemahan dari Bukti P-1, kedua bukti ini dapat dikatakan merupakan bukti utama yang diandalkan oleh Pihak Pengguat, yang mana dalam gugatan Penggugat menjelaskan bahwa Bukti P-1 ini merupakan bukti kepemilikan tanah yang sah yang diberikan oleh pemerintah Belanda.

Dalam amar pertimbangannya, Majelis Hakim setelah memeriksa bukti P-1 ditambah dengan fakta yang disebutkan dalam terjemahan surat Belanda tersebut sebagaimana termaktub dalam bukti P-5, Majelis Hakim memutuskan untuk menolak seluruh bukti tersebut dikarenakan bukti tersebut hanya menjelaskan bahwa Pemerintah Hindia Belanda pernah mengangkat (Alm) Mandongung Pulungan sebagai kepala Kuriah, tanpa menjelaskan dan/atau menyatakan lebih lanjut mengenai hak atas tanah dari Penggugat.

Majelis Hakim lebih lanjut mempertimbangkan bahwa PT Agincourt Resources telah mengajukan bantahan atas semua bukti maupun pernyataan saksi yang diajukan penggugat dengan mengeluarkan bukti hukum yang sah atas proses pembebasan lahan dan pembayaran kompensasi kepada para pemilik lahan. PT Agincourt Resources juga menghadirkan saksi ahli utama yang merupakan Kepala Biro Bantuan Hukum dan Hubungan Masyarakat pada Badan Pertanahan Nasional yang memiliki kapabilitas dan kapasitas untuk memberikan penjelasan terkait  dengan pengetahuan akan hak-hak atas tanah dan/atau kepemilikan tanah berdasarkan hukum dan perundangan yang berlaku  di Indonesia.

Sehubungan dengan gugatan provisi dari pihak penggugat yang meminta kepada Majelis Hakim agar memerintahkan PT Agincourt Resources untuk menghentikan sementara seluruh kegiatan penambangan dan meletakan sita jaminan atas pabrik (processing plant), Majelis Hakim beranggapan bahwa gugatan provisi penggugat tidak berdasar dan oleh karenanya harus ditolak secara keseluruhan.


Kuasa Hukum PT Agincourt Resources, Sangti Nainggolan dari Marx & Co Law Firm menyatakan berdasarkan pertimbangan-pertimbangan tersebut di atas, Majelis Hakim akhirnya memutuskan untuk menolak seluruh gugatan yang diajukan pihak penggugat. “Ini berarti bahwa pengadilan secara sah memastikan bahwa PT Agincourt Resources memiliki hak secara hukum untuk menggunakan dan/atau menguasai lahan untuk operasionalnya,” kata Sangti.


Sangti menambahkan, hasil terjemahan dari surat Bewijs Van Erkening No. 27 yang diklaim oleh Penggugat sebagai alas hak atas 3000 Hektare, hanya menjelaskan proses penunjukan Mandongung Pulungan sebagai Kepala Kuriah atau Kepala Desa, dan tidak menjelaskan sedikitpun tentang Hak Kepemilikan atas tanah.

Sangti menjelaskan, tanah yang disengketakan tersebut berada di dalam wilayah konsesi Kontrak Karya milik PT Agincourt Resources dan pihak perusahan telah melakukan proses penggantian hak atas tanah untuk setiap tanah yang dibebaskan dan selanjutnya dikuasai sejak tahun 2008.

Pada saat pelaksanaan pembebasan tanah tersebut telah dibentuk Tim Fasilitasi Pembebasan Tanah secara Independen oleh Pemerintah Kabupaten Tapanuli Selatan. Tim Fasilitasi tersebut terdiri dari Bupati Tapanuli Selatan, Dandim 0212/TS, Kapolres Tapanuli Selatan, Kepala Kejaksaan Negeri Padang Sidimpuan, Ketua Pengadilan Negeri Padang Sidimpuan serta Ketua DPRD Tapanuli Selatan. Di samping itu sejumlah Dinas instansi terkait dari Pemerintah Daerah Kabupaten Tapanuli Selatan, mulai dari Kepala Dinas Pertambangan dan Energi Tapanuli Selatan, Kepala Bagian Pertanahan, Kantor Pertanahan Tapanuli Selatan, Camat Batang Toru dan Kepala Desa Napa, juga terlibat dalam tim ini. Sementara itu pihak Penggugat sendiri tidak pernah mengikuti proses pembebasan tanah yang dilakukan oleh PT Agincourt Resources pada tahun 2008 hingga 2010.

Tambang Emas Martabe memperoleh gugatan perdata dari para keturunan Raja Mandongun Pulungan (Alm), yakni Berlian Pulungan, Seriya Pulungan, Megawati Pulungan dan Hamdan Pulungan (Alm) melalui kuasa hukumnya Kamaluddin, SH & Associates Law Office  di Pengadilan Negeri Padangsidimpuan, Tapanuli Selatan dengan nomor registrasi perkara 22/PDT.G/2016/PN.PSP pada tanggal 16 Mei 2016.

Dalam gugatannya, pihak Penggugat mengklaim memiliki harta peninggalan berupa sebidang tanah seluas 3000 hektare, yang terletak di Desa Napa, Kecamatan Batang Toru, Kabupaten Tapanuli Selatan yang saat ini menjadi bagian dari lahan pertambangan PT Agincourt Resources. Keluarga Pulungan mengklaim bahwa tanah tersebut merupakan tanah Loehat atau tanah yang dimiliki secara turun temurun dalam satu garis keturunan, yang dikuasai oleh Raja Mandongung Pulungan sejak tahun 1931 yang diberikan oleh Belanda atas nama Resident Tapanoeli berdasarkan Bewijs Van Erkening No. 27 yang dikeluarkan oleh Residen Tapanoeli pada tanggal 3 September 1931.

Adapun batas – batas tanah yang disengketakan tersebut menurut penggugat adalah sebelah utara dengan hutan lindung. Sebelah selatan dengan area penggunaan lain (APL) yang digarap oleh masyarakat. Sebelah barat dengan APL yang digarap oleh masyarakat. Sementara sebelah timur dengan kawasan hutan lindung dan sebagian digarap oleh masyarakat. Dari total 3000 Hektare, 500 hektare dari tanah yang disengketakan  berada di APL yang dikuasai dan dijadikan operasional pertambangan oleh PT Agincourt Resources. Atas hal tersebut di atas, para penggugat meminta ganti rugi sebesar Rp.150.000.000.000 (seratus lima puluh miliar rupiah) dengan perhitungan 1 hektare seharga Rp.300.000.000 (tiga ratus juta rupiah). On October 17, a French judge placed the nearly 90-year-old Liliane Bettencourt, a billionaire, under the guardianship of her grandson. The ruling was the culmination of a long battle with her only child Françoise Bettencourt-Meyers who first sought to put the brakes on her mother’s over-the-top largesse toward celebrity photographer François-Marie Banier four years ago. Bettencourt was enthralled with Banier, bestowing upon him a total $1.3 billion in cash and gifts. A subsequent reconciliation between mother and daughter was short-lived, when Bettencourt-Meyers discovered that her mother’s lawyer and guardian got her to invest some $200 million in an online gambling company that belonged to one of his clients.

Weighing heavily in the judge’s ruling was the fact that a neurologist and a psychologist who had tested Bettencourt, had declared that she flunked cognitive tests. Those tests, however flawed, are given to patients suspected of dementia. Alzheimer’s is the most common form of dementia, and short of an autopsy, there’s still no other way of diagnosing it. According to the French daily Le Monde, the specialists concurred that Bettencourt is at a moderately severe stage of Alzheimer’s. What’s interesting is the medical term “anosognosie” they also used to describe Bettencourt's condition. It’s when a patient is completely unaware of his sickness, and in fact denies it.

For every Pat Summitt, the University of Tennessee Lady Vols coach who recently announced she had early onset Alzheimer's, there's probably a patient who rejects the prognosis, and insists on carrying on as usual. That includes a refusal to relinquish control over finances—a potential blow to their self-esteem and sense of power. But poor judgment over money matters--such as investing $200 million in a company at the alleged behest of a guardian with potential conflicts, is one of the symptoms of Alzheimer’s. It might take a painful financial loss for family members to realize that.


Bettencourt’s offspring will remain very wealthy; their fortune is tied to the success of L’Oreal. Bettencourt, who’s worth more than $20 billion, inherited her money from her father Eugene Schueller, the founder of the cosmetics giant. She had already agreed to turn over her 30% stake to her daughter.

Akibat meluasnya kerusuhan Libya, perusahaan Eropa ungsikan stafnya
Harga minyak mentah dunia meningkat sebagai tanggapan terhadap pergolakan di Libia.
Minyak mentah jenis Brent melonjak 1,7% dalam perdagangan hari Senin (21/02/2011) menjadi US$104,25 per barel. Harga ini merupakan yang tertinggi sejak krisis keuangan tahun 2008.

Sementara itu beberapa perusahaan energi Eropa memindahkan stafnya dari Libia yang merupakan produsen besar minyak dan gas untuk pasar Eropa

Harga saham perusahaan Italia ENI yang aktif di Libia turun 4,4%.
Perusahaan Italia itu mengatakan operasinya di Libia tidak terganggu insiden kekerasan.
Italia membeli sepertiga minyak dan gas dari Libia sehingga menjadi konsumen terbesar sejauh ini.
Menurut pengamat, ENI telah membeli gas dari Libia selama berpuluh tahun dan merupakan pusat kedekatan hubungan politik diantara kedua negara.

Pada tahun 2008-2009, pemerintah Libia mempertimbangkan untuk membeli sampai 10% saham ENI meskipun rencana investasi ini tidak berlanjut.

Sekitar 13% pemasukan ENI berasal dari Libia dan 30% dari Afrika Utara. Oleh karena itu perusahaan Italia ini sangat rawan terhadap gejolak kawasan.

Meskipun adanya keprihatinan itu, perusahaan ini masih memfokuskan kepada dampak jangka pendek kerusuhan.
Pengamat mengatakan muncul pula kekhawatiran aset-aset ENI di Libia serta perusahaan asing lainnya dinasionalisasi.
Sementara itu saham perusahaan Austria OMV yang juga aktif di Libya turun 5% hari Senin.
OMC bersama Royal Dutch Shell dan perusahaan Statoil dari Norwegia mengatakan sedang menyiapkan pemindahan stafnya.
BP juga berniat mengungsikan sekitar 140 pekerjanya dari Libya

Biography

You know a divorce is getting messy when one side descends to accusations  such as “your dad is an evil genius” and references to a “pile of turd”.

But when corporations split, titans of global industry are usually careful to wash their dirty linen in private.

So it was a surprise when the financier Nat Rothschild and a prominent Indonesian businessman, Aga Bakrie, engaged in a spectacular and very public bust-up on Twitter.

Yesterday saw the wealthy Bakrie family agree a deal to cut ties with London-based investors and buy back their stake in the mining firm Bumi.

Mr Rothschild, 42, who had helped to broker investments in the firm, then tweeted: “@agabakrie7 thanks for buying back a worthless pile of turd. I look forward to watching Bumi TBK trading to zero.”

He then told Mr Bakrie: “Whilst your dad is an evil genius (yes I’m paying Nirwan a compliment), the word on the street is that you are extremely DUMB!”

“Haha... ‘Dumb’ I believe that’s the word that has been associated with you by most of the people that i have met,” was Mr Bakrie’s best attempt at a comeback.

Mr Rothschild demanded to know why several Bakrie family firms were “trading at zero”. But Mr Bakrie replied: “Since they are all public company listed in Indonesian exchange, please buy 1 shares and address all question to management.”

He celebrated the return of Bumi to Indonesia, saying: “Protect Country resources from imperialist. Good  bye London... It was a bittersweet experience.”

That provoked Mr Rothschild to further fury. “What about protect minority shareholders from Bakrie? Why is investing 1.2b [dollar] into Indo bad for Indonesia you dumb schmuck?!”

“Indonesia is an amazing investment haven... only bad when a minority try to take control by dirty trick,” Mr Bakrie responded.

“No family has done more to blacken Indonesia’s investment climate than yours,” Mr Rothschild hit back.

However, Mr Bakrie attempted to rise above the acrimony, tweeting: “Congrats on the separation, all the best for you. As we Indonesian say selamat malam pak [“good evening sir”] Nat.”

Oei tjong tjay is the last son of oei tiong ham, he was born in Singapore in 1924. His mother is Ho Kiem Hoa Nio. He received primary education in Netherlands, and secondary and university education in Switzerland. He went to US for graduate study in economics.

he returned to indonesia In 1948. He lead kian gwan indonesia after his half brother oei tjong hauw died. In 1961 indonesia government nationalized oei tiong ham concern.
